It is agreed between the Seller and Buyer(s) as follows this puppy/dog is sold pursuant to the terms of this Contract as follows:

Any and All Dogs sold as Pets will be spayed/neutered prior to placement…there are no exceptions.
This Contract applies only to the puppy/dog listed above and is non-transferable to another puppy/dog from Dazzlin’ Yorkshire Terriers. Any replacement/substitution puppy/dog will be specified and bound by a separate Contract rendering this Contract null and void.
2. SELLER’S REPRESENTATIONS / STIPULATIONS / CONSIDERATIONS
A. The following representation and conditions apply to the aforementioned puppy/dog: the Seller guarantees that the puppy/dog is free of life threatening diseases or disabilities (i.e., heart murmurs, parvo, etc.) for 72 hours after delivery to the Buyer(s). The Seller guarantees that the puppy/dog is a purebred Yorkshire Terrier with an AKC Litter Registration from the aforementioned Sire and Dam and that it was carefully and painstakingly reared. The Seller furthers guarantees that the Sire and Dam were bred with the aim to produce healthy and sound offspring. If the Buyer(s) elect to have DNA testing performed to confirm the parentage of the puppy/dog beyond the specifications in Section 1, such testing will be done at expense of the Buyer(s) including expenses for DNA samples taken from the specified sire and dam. The Seller maintains current DNA records on all sires utilized for breeding and will make these records available for inspection for confirmation of DNA parentage testing.
B. The puppy/dog has been examined on a routine basis by the Seller’s Veterinarian and the puppy/dog has been vaccinated (and dewormed if indicated), bile acid tested within normal ranges, spayed or neutered, and evaluated for structural and other health defects. The puppy/dog is guaranteed to be in sound, healthy condition at the time of the purchase. The Seller will provide to the Buyer(s) written proof of all inoculations administered to the puppy/dog during its lifetime, and copy of Bile Acid test with results.
C. The Buyer(s) have 72 hours after receipt of the puppy/dog to have the puppy/dog examined by a licensed Veterinarian. If, as a result of the examination, the Veterinarian determines that the puppy/dog is not sound and is not in good health, then the Buyer(s) shall decide to keep the puppy/dog or return the puppy/dog to the Seller for a refund or replacement puppy/dog at the Seller’s discretion. If the Buyer(s) elect to return the puppy/dog to the Seller, the Buyer(s) shall, within 7 days after the date of the signing of this Contract, send to the Seller by certified mail a written Veterinarian's certificate stating the condition(s) the Veterinarian’s examination disclosed. Upon receipt of the Veterinarian certificate, the Seller will contact the Buyer(s) to discuss arrangements for the return of the puppy/dog to the Seller. The Buyer(s) are responsible for the safe and reliable return of the puppy/dog to the Seller at the Buyer(s) expense; it is imperative that the best interest of the puppy/dog is primary concern during this return. These concerns would also include the shipping arrangements (car, train, airline, etc.), weather conditions at time of travel, shipping conditions available and any other considerations for the puppy/dog. The Seller, upon receipt of the puppy/dog, will have the aforementioned Veterinarian examine the puppy/dog (or another Veterinarian of the Seller’s choice) within 48 hours. If it is subsequently determined the puppy/dog is not healthy or sound the Seller is responsible for the prompt refund of the entire purchase price (including any and all deposits paid) of the puppy/dog or the replacement of the puppy/dog with another puppy/dog of equal value at the Seller’s discretion and future performance under this Contract will be null and void. If the Buyer(s) elect to keep the puppy/dog after the Veterinarian’s diagnosis of ill health of the aforementioned puppy/dog then the Buyer(s) forfeits all claims and shall be solely responsible for any and all future Veterinarian expenses for the puppy/dog and the Buyer(s) will be bound by all the terms of this Contract. See Section 1, J. for definitions and provisions of the Two Year Health Guarantee and such Guarantee shall be made a part of this Contract.
D. Possession of the puppy/dog will the transferred to the Buyer(s) for the purchase price of $_________ in U.S. dollars. This amount is to be paid in full prior to the physical transfer of the puppy/dog from the Seller to the Buyer(s). This purchase price includes the deposit amount of (1/4 Purchase amount) $________ paid on ____/____/________. If the Buyer does not pay the balance due for the puppy/dog at scheduled time of transfer by cash or money order, this Contract is null and void, the puppy/dog will remain in the possession of the Seller and the Buyer forfeits all deposit monies paid. This deposit amount paid can be transferred to another puppy/dog at the agreement of both the Seller and the Buyer(s) at the Seller’s discretion.
E. The Buyer(s) understand that once a deposit is paid to the Seller, it is a commitment to purchase said puppy/dog. The Buyer(s) may receive a refund of deposit monies paid only in the event of the Seller’s inability to meet the terms of this Contract (example: due to health of said puppy/dog being compromised rendering the puppy/dog incapable of meeting the Buyer(s)’s needs or the untimely death of said puppy/dog). In the case of Seller’s inability to meet the terms of this Contract, the Buyer(s) have the option of receiving a full refund of all deposit monies paid or redirection of the deposit towards the purchase of a different puppy/dog from Dazzlin’ Yorkshire Terriers, either a current puppy/dog from Dazzlin’ Yorkshire Terriers or a future puppy/dog from Dazzlin’ Yorkshire Terriers, to be determined by the Seller.
F. If delivery of the puppy/dog to the Buyer(s) is requested, any costs involved in air shipping will be the responsibility of the Buyer(s) including shipping crate, insurance during shipping (strongly recommended by Seller), cost of freight charges, any and all charges and costs for documentation required for shipping inside and outside the Continental United States. If such delivery is to be by car transport from Seller to Buyer(s) the Seller and Buyer(s) will agree upon a rate of compensation to the Seller for such transport.
G. The Buyer(s) agrees to release Seller and Seller’s estate from any and all damages and/or liabilities by fault of the aforementioned puppy/dog after transfer of possession of the puppy/dog. These damages include, but are not limited to, destruction of property and/or physical damage to any person(s) or group of people.
H. Buyer(s) agree to notify the Seller of any and all changes of address of the location/living arrangements of puppy/dog and Buyer(s) during the lifetime of the aforementioned puppy/dog.
I. Buyer(s) agree to maintain contact with the Seller, either by telephone, fax, in person, e-mail or US Postal mail, regarding the development and life of the puppy/dog to advise and inform the Seller of the condition and state of health and well-being of the puppy/dog during the lifetime of the puppy/dog.
J. The Two Year Health Guarantee is issued by the Seller to the Buyer(s) of the puppy/dog and is valid only for the puppy/dog named in Section 1. of this Contract and is only valid for the original Buyer(s) listed in Section 1. The Two Year Health Guarantee is void if the puppy/dog is resold or given away to another Buyer(s) other than the Buyer(s) listed in Section 1. The Seller, in issuance of this Guarantee, hereby ensures the good health of the above named puppy/dog as identified in Section 1 and by the AKC Registration and litter number. This puppy/dog is determined to be free of genetic defects and in excellent health as of the issue date of this Guarantee. Conditions that are covered for One (1) year from the date of purchase are: Stage 3-4 Subluxated Patellas (not caused by injury) and Leggs‑Calves Perthes. Conditions that are covered for two (2) years from the date of purchase are: Collapsing Trachea, Congenital Heart Disease, Congenital Deafness, Renal Dysplasia, Hypoplasia, Progressive Retinal Atrophy (PRA) and Liver Shunt or MVD. The puppy/dog has been examined and evaluated by a licensed Veterinarian and has received all recommended vaccinations appropriate to age. This Health Guarantee does not cover the puppy/dog for sickness and death that is otherwise preventable by proper maintenance and appropriate and recommended vaccinations, or any result of an accident, mistreatment or neglect. Such preventable diseases and illnesses include, but are not limited to: Hepatitis, Parvovirus, Corona, Distemper, Para Influenza, Rabies, Dental Disease, and Heartworms. Proper care and timely inoculations(s) will prevent the above diseases and the Seller is not responsible for the Buyer(s)'s non-compliance with recommended Veterinarian care and treatment. If, as a result of the examination by a licensed Veterinarian, it is determined that the puppy/dog is not in good health and has developed symptoms of canine congenital defect, excluding dental overbite/underbite, the Buyer(s) shall elect to keep the puppy/dog or return the puppy/dog to the Seller for a replacement puppy/dog of equal quality. If the Buyer(s) elect to keep the puppy/dog with the knowledge and correct diagnosis of the congenital defect, the Buyer(s) releases the Seller from any and all moral, legal and financial responsibility of such defect by acceptance of the puppy/dog with the defect as diagnosed. If the Buyer(s) elect to return the puppy/dog, the Buyer(s) shall, within 10 days after the date of diagnosis of the congenital defect, send to the Seller, by certified mail, a written Veterinarian's certificate stating that the puppy/dog was in ill health and stating the congenital defect noted/diagnosed. Upon safe and sound return of the defective puppy/dog to the Seller by the Buyer(s), at the expense of the Buyer(s), the Seller shall be obligated to replace the puppy/dog with one of equal quality from a current litter or future litter of the same sire and dam, and further performance under this Contract shall be null and void. The Buyer(s) may also elect to accept a puppy/dog from a current or future litter with other parentage if the Seller is agreeable to this provision.
3.CARE AND MAINTENANCE OF THE PUPPY/DOG BY THE BUYER(S)
A. The Buyer(s) agree to maintain the puppy/dog in a suitably clean and healthy environment and to provide proper balanced nutrition, clean and fresh water, adequate exercise and socialization, any training (i.e., obedience or conformation or agility), proper annual Veterinarian examinations, inoculations, heartworm and flea/tick preventative for the lifetime of the puppy/dog. The Buyer(s) also agree to provide proper shelter for the puppy/dog inside the Buyer(s) home or appropriate weatherproof and temperature controlled kennel and agrees the puppy/dog will not be kept outside in a run area or fenced area or tied to any stationary object and left alone. The Buyer(s) agree not to allow the puppy/dog to roam freely unleashed outside the home or appropriate weatherproof and temperature controlled kennel. The Seller strongly recommends permanent identification of the puppy/dog by the Buyer(s) in the form of tattoo or microchip and registration of such identity in the Buyer(s) name(s). If the puppy/dog is found to be inadequately cared for, abused, neglected, abandoned, harmed or mistreated by the Buyer(s), the Seller has the right to take repossession of the puppy/dog, with legal means and assistance if required. Such repossession of the puppy/dog will be at the Buyer(s) expense, including any and all expenses incurred for such repossession and transfer of the AKC registration to the Seller.
B. The Buyer(s) agree the aforementioned puppy/dog will remain in the Buyer(s) possession and care for the lifetime of the puppy/dog. If, at anytime during the lifetime of the puppy/dog, the Buyer(s) are unable or unwilling to care for the puppy/dog the Buyer(s) agree to contact the Seller and offer the Seller First Right of Refusal in purchasing the puppy/dog for the original purchase price of the puppy/dog before offering same to another person/party/entity. If the Seller is unable or unwilling to purchase the puppy/dog from the Buyer(s) the Buyer(s) agree to consult with the Seller on finding an appropriate and suitable home for the puppy/dog. The Buyer(s) further agrees that neither the Buyer(s) or the Buyer(s) estate/executors will transfer the puppy/dog and/or the registration of said puppy/dog to any person or organization other than the Seller, whether by sale, gift, loan or otherwise, unless previously agreed to by Seller in writing. The Buyer(s) agree to notify the Seller as soon as such contingency arises and will not abandon the puppy/dog to a shelter or sell or give away the puppy/dog to another person, party or entity. If the Buyer(s) sell or give away the puppy/dog without the Seller’s foreknowledge and written consent, the Seller can take legal action against the Buyer(s) at the full expense of the Buyer(s) for all legal costs and charges incurred.
C. The Buyer(s) agree that they are not acting as or in part of, an agent in the purchase of this puppy/dog and that the Buyer(s) will not sell this puppy/dog and/or any of the puppy’s/dog’s progeny to any agent, pet store, puppy mill, mass-producing kennel, laboratory, medical research facility or animal experimentation facility/entity. If the Buyer(s) sell or give away the puppy/dog to any agent, pet store, puppy mill, mass-producing kennel, laboratory, medical research facility or animal experimentation facility/entity without the Seller’s foreknowledge and written consent, the Seller can take legal action against the Buyer(s) at the full expense of the Buyer(s) for all legal costs and charges incurred if such a transfer of the puppy/dog occurs.
D. This Contract applies only to the puppy/dog listed on Page 1, paragraph 1, of this Contract and is non-transferable to another person, party or entity.
